I wonder if Honda would have a claim to say the bikes been stolen if the dealers were instructed to scrap the machine and they clearly didn't comply.

It may be 30k but whoever put it together left a corner of the cambox gasket hanging out. If I saw that I wouldn't be happy to trust the rest of the bike.

Deep in memory, I have something like a tab on those cam cover gasket that stood out, but really can't be sure if true or where it was sited.

A theft charge would not cross the first  evidential hurdle no dishonest appropriation of the property - that's my view.

That does not mean that Honda could not consider a civil claim to have the bike returned - I suspect a civil claim would be outside the time limits for such action - I know little about civil law.

Surely it was dishonest of the dealer not to comply with specific instructions from the owner of the bike, Honda would assume the bike had been destroyed and they have never relinquished ownership so any subsequent ownership is null and void

Dont know about a tab but remember needing a tube of evostick and 3 Honda "Blue Book" manuals to get the new gasket to stay in whilst refitting cover after tappet adjustment

The Theft Act 1968 does not define in law what is meant by "Dishonest" though it does give examples of what might "not be dishonest". If you give me £100 to help me buy a car but instead I spend it to go on holiday I have not dishonestly appropriated the £100 you gave me by doing something different with the money.  That's before we even start with mens rea & actus reus.
Definitely an out of time Civil Law case - here in the UK it might have been impossible to first register the vehicle without the manufacturers V55/1 form from Honda. Today most new vehicles are registered directly by the supplying dealer via a special computerised direct registration system to DVLA - forgotten the name of the system - even so sometimes a dealer will use a V55/1  it's very similar to the V55/5 except it has extra codes from the manufacturer as well as the Engine & Chassis numbers plus other stuff.

Sheesh, £30k - I used to own a red one and to be honest, I thought it a death trap. Remember getting into a weave on the M11 and that made parts of my body pukker. I met a guy in Feltham at the time who had NO'd his bike - nutter of a bike.....
Can't remember the reg of mine otherwise I'd look it up.

Rode a CBX once. Honda used to do an open day at Donington. You could ride anything in the range!

My memories were engine, engine and size. Wouldn't like to press on round the Twisties on one.

I believe it's where you play classical music in the background whilst restoring it and keep telling the bike, "Now, now, it'll be fine in the end!"

I, of course, could be wrong!
