Looks like after the court case with Honda Dave silver has come out fighting with a new strategy, to copy lots of parts that honda no longer has the copyright for, which is good news for us lot

'Then' and 'than' are completely different words and have completely different meanings. Same with 'of' and 'have'. Set and sit. There, their and they're. Set/sit. Bought/brought FFS. Bloody Americans.

Honda Motor Co Ltd (1) Honda Motor Europe Ltd v David Silver Spares Limited [2010]

One recent decision of the High Court provides confirmation that the onus remains on the Defendant to such actions to demonstrate the origin of the branded goods they sell. In the above case, Honda alleged that David Silver Spares Limited ("David Silver") had infringed its registered UK and Community trade marks for HONDA by purchasing genuine Honda parts from outside the EEA and selling them within the EEA without Honda's express consent.

David Silver denied that it had infringed Honda's trade marks. It sought to argue that the products were purchased within the EEA. It claimed, however,that as Honda had exclusive distribution agreements with companies covering various EEA member states, if it were obliged to disclose which of those distributors they had been purchased from, Honda could potentially prevent such further legitimate sales being made to David Silver in the future harming competition and partitioning the European market. David Silver claimed the onus should be on Honda to prove that the goods were initially placed on sale outside of the EEA by the company, or with its consent.

The judge refused to reverse the burden of proof and stated that the onus remained on David Silver to prove that Honda had consented to such sales and that it had unequivocally demonstrated an intention to renounce its rights.
